PREAMBLE​

We, the members of Hayya Alal Falah Society, Aligarh, in pursuance of the principles outlined in this constitution, and in accordance with the laws governing societies, hereby adopt and enact this constitution for the better functioning, governance, and achievement of the objectives of our esteemed organization.

Procedure for the Amendment in the Rules and Regulations of the Society:

The Constitution can be amended by the General Body, if the proposed amendment is supporting by two-third ( 2/3rd ) of the the members present at the meeting subject to the approval of the President.

Funds of the society

The Organisation will keep its accounts in nationalised banks of India. The account shall be operated by the President and theTreasurer jointly

Dissolution of the society and the procedure regarding settlement of the assests and properties under section 13 & 14 of the societies registration act:

Dissolution of the society

The assets and properties of the Society shall not be in the name of all the debts, If any, standing against the said society shall be paid out any individual. In the event of the dissolution of the Society, first of all the debts, if any, standing against the said Society shall be paid out. The remainder of the assets and properties shall be transferred, according to the resolution adopted by the majority of the members as well as approved by the top most spiritual leader,to any educational institution, orphanage, mosque, hospital or any other religious society, which must be functioning in line with the objectives similar to those of the Society.

Audit of the accounts of the society

The Executive Committee shall appoint an Auditor for a period of three years.

Qualification

 

  • He should be a qualified Auditor who is a Chartered Accountant.
  • All legal matters would be dealt with by the President or his nominee
    and the disputes would be subject to Aligarh jurisdiction.
